Since tenant has moved into the Tradewinds Apartments at 403 Junction Avenue in the Fall of 2013, the motorcyclist and his motorcycle have been generating loud noises in excess of 120 decibels between the hours of 12:30am and 5:10am at various nights. This is illegal under Livermore Municipal Code, sections 9.36.10, 9.36.30, 9.36.40 and 9.36.50. 9.36.10 establishes that there is a noise ordinance inside Livermore city limits. 9.36.30 establishes that it is illegal to generate such noise as it disturbs the residents of Livemore. 9.36.40 establishes that it is illegal to operate noisy internal combustion engines during nighttime hours. 9.36.50 outlaws the use of loud exhaust systems inside Livermore city limits, regardless of the time of day. Complaints have been made to the apartment complex management over the noise by several neighbors but nothing seems to be done about it. As recently as Friday, 21 March 2014 at 5:10am, this motorcyclist has used the parking lot at Tradewinds Apartments to start his vehicle and then ride it right around the bedroom windows of the folks in the southeastern part of the complex, which is less than 20 feet away from the windows of these folks. There have been other times like on Friday 21 February 2014 where the same motorcyclist and motorcycle have been heard at 12:30am and on Monday 03 February 2014 that this motorcyclist and motorcycle have been running at 3:30am. We are also looking at taking legal action and at this time are undertaking the gathering of further evidence, including video and photographic surveillance as well as further decibel readings. Any evidence that is gathered will also be turned into the Livermore Police Department to find out if even criminal or nuisance charges can be filed against the offender.
